Judy, Karen, Cindy, Jim, John and the entire McHugh family:
I am deeply saddened to learn of Tom’s passing and regret that I cannot be in West Virginia to express my profound sympathy and condolences to each of you personally. My heart breaks for you. Paula and I are living temporarily in south Florida and I’m unable to get back to Charleston in time for his services. However, I will be with you in spirit and in prayer.
I thought the world of Tom McHugh. He was many things to me and every lawyer who practiced before him in both the Circuit Court of Kanawha County and the West Virginia Supreme Court of Appeals. He was a role model for judges, lawyers and for me personally. He was the epitome of a gentleman and a scholar as well as the quintessential jurist. He was a model of judicial temperament. He, without exception, treated everyone who litigated or otherwise appeared before him with dignity, respect, patience, compassion and his undivided attention. Never once did I see or even hear of him being abrupt, impatient or demeaning to anyone. Whether his rulings were for you or against you, one always knew his decisions were well thought out, well reasoned and fair. He believed in the Rule of Law.
As a Supreme Court Justice he presided during a time of significant legal and political change. He did so with grace and the confidence of knowing he was doing what was right and just. He worked with, managed and tolerated some difficult personalities in fellow jurist and did so without losing focus on the case before him what was the correct thing to do.
He was universally admired and respected. I was privileged to call him “my friend”.
The world is a better place because he was here. Like you, I will miss him greatly; but, his legacy and a piece of him will live on in everyone whose life he touched. I pray that you find peace and comfort in memories of the times we had him in our lives.
With deepest sympathy, Tom Flaherty
